Terms of Use

1. About Kavera and these Terms

1.1 Kavera is a brand owned and operated by Adept Solar Grown Diamond LLP, a limited liability partnership incorporated under the Limited Liability Partnership Act, 2008, with LLPIN [●] and GSTIN [●], having its registered office at [address], Surat, Gujarat, India ("Kavera", "we", "us" or "our"). Every sale made through a Kavera Channel is made by Adept Solar Grown Diamond LLP.

1.2 These Terms of Use ("Terms") govern your access to and use of the Platform and every purchase you make through a Kavera Channel. By browsing the Platform, creating an Account or placing an order, you agree to these Terms.

1.3 These Terms include, and are to be read with, the following policies published on kavera.in (together, the "Policies"): the Privacy Policy, Cookie Policy, Shipping & Delivery Policy, Cancellation, Returns & Refund Policy, Lifetime Exchange & Buy-Back Policy, Warranty & Lifetime Care Policy, Bespoke & Custom Creations Policy, Certification & Authenticity Policy, Pricing & Payments Policy, Offers, Promotions & Kavera Credit Terms, and Grievance Redressal Policy. If a Policy and these Terms differ on a matter that the Policy specifically covers, the Policy applies.

1.4 Nothing in these Terms or the Policies excludes or limits any right you have under the Consumer Protection Act, 2019, the rules made under it, or any other law that cannot be excluded by agreement. Where the law gives you a greater right, the law applies.

1.5 Kavera publishes short summaries of these Terms and the Policies on product pages, at checkout and elsewhere on the Platform. The summaries are written to match these Terms and the Policies, which set out the complete terms.

2. Definitions

In these Terms and every Policy, the following words have the meanings given below.

2.1 "Account" means your registered account on the Platform.

2.2 "Bespoke Product" means a Product made to a design, specification or personalisation requested by you, including any Product that is engraved or personalised, made in a non-standard size at your request, or created through Kavera's bespoke design service.

2.3 "Business Day" means any day other than a Sunday, a national holiday or a public holiday in Gujarat.

2.4 "Delivery Date" means the date on which a Product is recorded as delivered in the logistics partner's tracking record or proof of delivery.

2.5 "Grievance Officer" means the officer named in the Grievance Redressal Policy.

2.6 "Kavera Channel" means the Platform, any retail store operated by Kavera (when and where opened), and any other sales channel that Kavera expressly identifies on kavera.in as its own. Products bought from any other person, including resellers and pre-owned sellers, are not purchased through a Kavera Channel.

2.7 "Kavera Credit" means a credit balance held in your Account, usable only towards purchases on Kavera Channels, on the terms of the Offers, Promotions & Kavera Credit Terms.

2.8 "Kavera-side Issue" has the meaning given in clause 3.2 of the Cancellation, Returns & Refund Policy.

2.9 "Made-to-Order Product" means a Product listed on the Platform as made to order, which is produced after you place your order, other than a Bespoke Product.

2.10 "Metal Value" means the Net Metal Weight of a Product multiplied by the Reference Rate for its Tested Purity on the Valuation Date.

2.11 "Net Metal Weight" means the weight of precious metal in a Product, measured by Kavera on a calibrated scale, excluding the weight of stones and any component that is not precious metal.

2.12 "Order Confirmation" means Kavera's email or SMS confirming that your payment has been received and your order has been accepted.

2.13 "Platform" means the website kavera.in, any Kavera mobile application, and any other digital interface operated by Kavera.

2.14 "Product" means jewellery, coins, bars or other goods purchased through a Kavera Channel.

2.15 "Product Documents" means, for a Product, its tax invoice, every SGL grading report or jewellery report supplied with it, and the Kavera authenticity card.

2.16 "Ready-to-Ship Product" means a Product listed on the Platform as ready to ship.

2.17 "Reference Rate" means the closing (PM) rate published by the India Bullion and Jewellers Association (IBJA) for the relevant metal and purity on the Valuation Date. If no rate is published for that day, the most recent published rate applies. If no rate is published for that purity, the published rate for 999 fineness applies, adjusted in proportion to the Tested Purity.

2.18 "SGL" means Solitaire Gemmological Laboratories, the independent gemological laboratory that grades and reports on Kavera's laboratory-grown diamonds and jewellery.

2.19 "Stone Value" means, for each laboratory-grown diamond in a Product, the price (excluding GST) at which Kavera offers a laboratory-grown diamond of the same shape, carat weight, colour, clarity, cut grade and growth method on the Valuation Date, as set out in Kavera's laboratory-grown diamond rate card. Kavera will share the rate card entries used in your valuation on request. If Kavera does not offer a comparable stone on that date, Stone Value is the prevailing wholesale market price for a comparable certified laboratory-grown diamond, and Kavera will state the basis of that price in writing.

2.20 "Tested Purity" means the purity of the metal in a Product as determined by Kavera's XRF or other standard assay testing, or its hallmarked purity, whichever is lower.

2.21 "Valuation Date" means the date on which Kavera completes its inspection of a Product and issues a Valuation Statement under the Lifetime Exchange & Buy-Back Policy.

3. Eligibility and Accounts

3.1 You may purchase from Kavera only if you are at least 18 years old and competent to contract under the Indian Contract Act, 1872. By placing an order, you confirm that you meet these requirements.

3.2 You may browse the Platform without an Account, but an Account is needed to place orders, track them, and use returns, exchange, buy-back and warranty services. You must give accurate, current and complete information when you register and keep it updated.

3.3 You are responsible for all activity in your Account and for keeping your login credentials and one-time passwords (OTPs) confidential. Tell us immediately at care@kavera.in if you suspect unauthorised use of your Account.

3.4 Each person may hold one Account. Kavera may refuse registration, or suspend or close an Account, under clause 20.

4. Use of the Platform

4.1 Kavera grants you a limited, non-exclusive, non-transferable and revocable licence to access and use the Platform for your personal, non-commercial use, in accordance with these Terms.

4.2 You must not:

(a) use the Platform for any unlawful, fraudulent or misleading purpose, or to buy Products for resale without Kavera's written consent;

(b) copy, scrape, harvest or extract any content, designs, images, prices or data from the Platform by automated means, including bots, crawlers or scripts;

(c) interfere with the security or operation of the Platform, introduce malware, attempt unauthorised access, or probe, scan or test the Platform's vulnerabilities;

(d) reverse engineer, decompile or modify any part of the Platform;

(e) impersonate any person, use another person's payment instrument without authorisation, or provide false information;

(f) post or transmit content that is defamatory, obscene, infringing, hateful, misleading or otherwise unlawful; or

(g) use any Kavera design, image or content to make, advertise or sell any copy or imitation of a Kavera Product.

4.3 Kavera may limit the quantity of any Product per customer, per Account or per order, and may decline orders that appear to be placed for resale.

4.4 Kavera aims to keep the Platform available at all times but may suspend it, wholly or partly, for maintenance, security or reasons beyond its control, and is not responsible for temporary unavailability.

5. Products and Product Information

5.1 Kavera sells laboratory-grown diamonds. Unless a product listing and its invoice expressly describe a stone as a natural diamond, every stone described on a Kavera Channel as a diamond is a laboratory-grown diamond. Laboratory-grown diamonds are created in a laboratory by the chemical vapour deposition (CVD) or high-pressure high-temperature (HPHT) method, and the growth method of each certified stone is stated on its grading report. Kavera describes its stones in accordance with IS 19469:2025.

5.2 Prices of laboratory-grown diamonds change over time and have historically declined. The resale value of a laboratory-grown diamond in the general market may be substantially lower than its purchase price. Kavera's Lifetime Exchange and Buy-Back commitments are Kavera's own commitments, calculated at the rates applicable on the Valuation Date. They are not a representation or guarantee of the market value, investment value or future price of any Product.

5.3 Gold jewellery sold by Kavera is hallmarked in accordance with the requirements of the Bureau of Indian Standards and carries a Hallmark Unique Identification (HUID) number where required.

5.4 Product images may be enlarged or retouched to show detail, and colours may appear differently on different screens. Weights shown for Products are approximate. The actual metal weight of a Product may vary by up to 5% from the weight shown, and a variation within this tolerance does not make the Product different from its description. The price you pay at checkout is final, and Kavera will not ask you to pay more because the actual weight is higher than the weight shown.

5.5 A grading report records the opinion of the laboratory that issued it on the date of grading. Different laboratories may grade the same stone slightly differently. A difference of one colour or clarity grade between SGL and another laboratory is normal variance and is not by itself a defect.

5.6 Ring and bangle sizes follow the size guide on the Platform. A Product made in the size you selected is not defective because it does not fit, and resizing is available under the Warranty & Lifetime Care Policy.

5.7 Kavera takes care to describe every Product accurately. If a Product differs materially from its description, your remedies are set out in the Cancellation, Returns & Refund Policy.

6. Prices

6.1 Prices on the Platform are in Indian Rupees and include GST. How prices are made up, how they change with metal rates, and when they are locked are set out in the Pricing & Payments Policy.

6.2 Where a Product is listed with a manifestly incorrect price or description, Kavera will inform you before dispatch and offer you the choice of proceeding at the correct price or cancelling with a full refund, as set out in the Cancellation, Returns & Refund Policy.

7. Orders and Contract Formation

7.1 Placing an order is an offer by you to buy the Products in your cart. A binding contract is formed only when Kavera sends you an Order Confirmation. Kavera may decline any order before sending an Order Confirmation, and will refund any amount already debited.

7.2 Kavera may ask for verification before confirming or dispatching an order, including where the order is of high value, the delivery address differs from the billing address, or the payment instrument is not in your name. If verification is not completed within 7 days of Kavera's request, Kavera may cancel the order with a full refund.

7.3 Each Product in an order is a separate contract, and Kavera may ship Products in an order separately.

8. Payment

8.1 Payment methods, EMI, cash limits, PAN requirements and failed transactions are governed by the Pricing & Payments Policy.

9. Delivery, Cancellation, Returns, Exchange, Buy-Back, Warranty and Bespoke Orders

9.1 Delivery and reverse pickups are governed by the Shipping & Delivery Policy. Cancellations, returns, refunds and the 7-day exchange are governed by the Cancellation, Returns & Refund Policy. Lifetime exchange and buy-back are governed by the Lifetime Exchange & Buy-Back Policy. Manufacturing defects and after-care are governed by the Warranty & Lifetime Care Policy. Bespoke orders are governed by the Bespoke & Custom Creations Policy.

9.2 Risk in a Product passes to you on delivery. Ownership passes to you on delivery, provided Kavera has received full payment.

10. Verification, KYC and Fraud Prevention

10.1 Kavera may ask you to complete identity and KYC verification, including your PAN, a government-issued photo identity document of your choice (such as a passport, driving licence, voter ID or masked Aadhaar), proof of address and bank account verification. Kavera may do so for high-value orders, buy-back payments, refunds to bank accounts, and wherever required by law, including applicable income-tax law and the Prevention of Money-laundering Act, 2002.

10.2 Personal data collected for verification is used for verification, legal compliance and fraud prevention, and is handled in accordance with the Privacy Policy.

10.3 Kavera may refuse, suspend or reverse any order, return, exchange, refund, warranty claim or buy-back where it reasonably suspects fraud, misrepresentation, tampering, substitution of stones or components, stolen property or abuse of the Policies, and may ask for additional verification before proceeding. Where Kavera reasonably believes that a Product presented to it is stolen, it may report the matter to the appropriate law enforcement authority and act on that authority's directions regarding the Product.

10.4 If a Product returned to Kavera is not, in whole or in part, the Product Kavera supplied, Kavera will reject the request and return what it received, and reserves all its legal remedies.

11. Your Responsibilities

11.1 You are responsible for providing accurate personal, delivery and banking details, for keeping your Account credentials and OTPs confidential, and for ensuring that high-value shipments are received by you or a person you have authorised. Kavera is not responsible for loss caused by inaccurate information you provide or by your disclosure of your credentials or OTP, except to the extent that the loss is caused by Kavera.

12. Reviews, Feedback and User Content

12.1 You may post reviews, ratings, photographs and other content on the Platform ("User Content"). Your User Content must be your own honest opinion of a Product you have purchased or used, must not be misleading or defamatory, and must not infringe anyone's rights.

12.2 Kavera publishes all genuine reviews, whether positive or negative, and does not edit them except to remove personal data, offensive language or unlawful content. Kavera may decline or remove User Content that breaches these Terms. Where a review was received in exchange for any benefit, Kavera will identify it as such.

12.3 You grant Kavera a non-exclusive, royalty-free, perpetual and worldwide licence to use, reproduce, display and adapt your User Content on the Platform and in Kavera's marketing, crediting you by the name you posted under. Kavera will ask for your separate consent before using any image in which you can be identified in paid advertising.

12.4 Suggestions and feedback you send Kavera may be used without restriction or payment.

13. Intellectual Property

13.1 The Platform and all content on it, including jewellery designs, product photography, videos, text, graphics, logos, the Kavera name and trademarks, software and the selection and arrangement of content, are owned by or licensed to Kavera and are protected by the laws of India, including the Copyright Act, 1957, the Designs Act, 2000 and the Trade Marks Act, 1999.

13.2 Except under the licence in clause 4.1, you may not copy, reproduce, distribute, modify, create derivative works from, or commercially use any content on the Platform, or manufacture or sell any jewellery that copies a Kavera design, without Kavera's prior written consent.

13.3 If you believe content on the Platform infringes your rights, write to care@kavera.in with details, and Kavera will review and respond within the timelines in the Grievance Redressal Policy.

14. Communications and Consent

14.1 You agree to receive transactional communications from Kavera, including order, payment, delivery, OTP, service and policy messages, by email, SMS, WhatsApp, calls and in-app notifications. These are necessary to fulfil your orders.

14.2 Kavera sends promotional communications only where you have given consent, and you may withdraw that consent at any time as set out in the Privacy Policy. Promotional communications are sent in accordance with the regulations of the Telecom Regulatory Authority of India.

14.3 Calls with Kavera's customer care may be recorded for quality, training, dispute resolution and fraud prevention, and you will be informed at the start of a recorded call.

15. Third-Party Services

15.1 Payments, financing, logistics and some other services are provided by independent third parties under their own terms. Kavera selects these providers with care and remains responsible to you for the Products it sells, but is not responsible for the separate terms of a third party, such as a financier's interest or a bank's processing timelines.

15.2 The Platform may link to third-party websites, such as SGL's report verification page. Kavera is not responsible for the content or practices of those websites.

16. Disclaimers

16.1 Content on the Platform, including style guides, care tips and educational material about laboratory-grown diamonds, is for general information. It is not financial, investment or valuation advice.

16.2 Except as expressly stated in these Terms and the Policies, and to the extent permitted by law, Kavera makes no representation about the uninterrupted or error-free operation of the Platform.

17. Limitation of Liability

17.1 Nothing in these Terms or the Policies limits Kavera's liability where the law does not permit it to be limited, including liability for defective goods, deficiency in service or under the Consumer Protection Act, 2019.

17.2 Subject to clause 17.1, Kavera is not liable for indirect or consequential loss, for delay caused by a Force Majeure Event, or for loss arising from inaccurate information provided by you, and Kavera's total liability for any claim relating to a Product shall not exceed the amount paid for that Product.

18. Indemnity

18.1 You agree to indemnify Kavera against any loss, claim or penalty that Kavera suffers as a direct result of your fraud, your wilful breach of these Terms, or any claim by a third party that User Content or reference material you supplied infringes that third party's rights.

19. Force Majeure

19.1 Kavera is not liable for any delay or failure to perform caused by events beyond its reasonable control, including natural disasters, epidemics, war, civil disturbance, strikes, government action and disruption of logistics or banking networks (a "Force Majeure Event"). Kavera will inform you of the delay and resume performance as soon as reasonably possible. If a Force Majeure Event delays delivery by more than 30 days, you may cancel the order for a full refund.

20. Suspension and Termination

20.1 Kavera may suspend or close your Account, or refuse service, where you breach these Terms, Kavera reasonably suspects fraud or abuse, or Kavera is required to do so by law. Kavera will tell you the reason unless it is prevented by law or the disclosure would prejudice a fraud investigation.

20.2 Suspension or closure does not affect orders already confirmed, refunds due to you, or your rights under the Warranty & Lifetime Care Policy and the Lifetime Exchange & Buy-Back Policy for Products you have purchased, except where those Products are the subject of suspected fraud.

20.3 You may close your Account at any time by writing to care@kavera.in. Kavera will keep the records it needs to honour your warranty, exchange and buy-back rights and to comply with law, as set out in the Privacy Policy.

21. Kavera Retail Stores

21.1 Kavera currently sells online only. When Kavera opens retail stores, they will be listed on kavera.in, and returns, exchanges, buy-back and warranty requests may then also be made at those stores under the Policies. Any additional terms that apply to in-store transactions will be displayed in the store.

22. Changes to these Terms and the Policies

22.1 Kavera may update these Terms or any Policy by publishing a revised version on kavera.in with its effective date. Each order is governed by the versions in force on the date of its Order Confirmation, subject to clause 9 of the Lifetime Exchange & Buy-Back Policy and to any change required by law. Earlier versions are available on request.

23. Governing Law, Jurisdiction and General

23.2 Subject to your right to file a complaint before the appropriate consumer commission under the Consumer Protection Act, 2019, including where you reside or work, the courts at Surat, Gujarat have exclusive jurisdiction over any dispute arising from these Terms or the Policies.

23.3 If any part of these Terms or a Policy is found unenforceable, that part shall be applied to the extent it is enforceable, and the rest remains in effect. Kavera's failure to enforce any provision is not a waiver of it.

23.4 You may not transfer your rights under these Terms without Kavera's consent. Kavera may transfer its rights and obligations to a successor to its business, and your rights under the Policies will continue against that successor.

23.5 Notices to you will be sent to the email address or mobile number in your Account. Notices to Kavera must be sent to care@kavera.in.
